2. The petitioner apprehends arrest in connection with Chandramandi P.S. Case No. 26 of 2023 dated 09-02-2023, instituted under Sections 341,323,308, 379, 504 and 34 of the Indian Penal Code.
3.The prosecution case, in short, is that on 08.02.2023 at around 4 PM, while the informant along with his cousin was returning home, they were intercepted by co-accused Chandan Kumar Yadav and others who had blocked the road while armed with sticks. The accused persons allegedly assaulted both persons, during which co-accused Chandan Kumar Yadav assaulted the informant on his forehead with the
Patna High Court CR. MISC. No.63153 of 2025(2) dt.10-09-2025 2/3 butt of a pistol, causing pain and swelling. It is further alleged that the accused persons snatched the informant's mobile phone, gold chain weighing 10 grams, and Rs.25,000/- in cash.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that there is no specific allegation against the petitioner; rather, the allegation levelled against him is general and omnibus in nature. The specific allegation of assaulting the informant on his forehead with the butt of a pistol has been made against co-accused Chandan Kumar Yadav and not against the petitioner. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Jamui, in Chandramandi P.S. Case No. 26 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
