Case No. 197 of 2019 registered for the offences punishable under Sections 354(D), 504/34 of the Indian Penal Code and Section 66(D) of I.T. Act.

Prosecution case is that petitioner has taken some photographs and made it viral and due to that marriage of the informant was broken.

Submission of learned counsel for the petitioner is that whole allegation is false and concocted and petitioner is a student and he is ready to abide by any condition that may be imposed on him and he is in custody since 3.5.2019. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.58190 of 2019(3) dt.08-01-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 197 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that if he tries to tamper with the evidence or threats the informant or her family members, prosecution is at liberty to move for cancellation of bail bonds of the petitioner.
