2. The petitioner seeks regular bail in connection with Barhara P.S. Case No. 422 of 2023 for the offence registered under Section 392 of the I.P.C.

3. As per prosecution case, three unknown persons stopped the bike of the informant and on the point of pistol snatched his bag containing the collection money of Rs. 80,620 and other materials.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case on the basis of his confessional statement which has no evidentiary value in the eye of law. Petitioner has never

Patna High Court CR. MISC. No.73670 of 2024(3) dt.29-11-2024 2/3 put on TIP and nothing was recovered from possession of the petitioner. Similarly situated co-accused namely Pradeep Kumar @ P.S. Samrat has already been granted regular bail by this Court vide order dated 29.01.2024 passed in Cr. Misc. No. 2276 of 2024. Petitioner has four criminal antecedent in which he is on bail. Petitioner is in jail custody since 26.08.2023 and he undertakes to cooperate in the trial of this case.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Barhara P.S. Case No. 422 of 2023, subject to following conditions:- (i) One of the bailors shall be own/close member of the family of the petitioner.

(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court below and shall remain physically present as directed by the Court below and on his absence on two consecutive dates

Patna High Court CR. MISC. No.73670 of 2024(3) dt.29-11-2024 3/3 without sufficient reason, his bail bond shall be cancelled by the Court below.
