2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 354(b), 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner is alleged to have forcibly attempted to commit rape on the daughter of the informant.
4. Learned counsel for the petitioner submits that the present case has been lodged in retaliation to Koilwar P . S. Case 204 of 2023 which was lodged by the mother of this petitioner against the informant and others and thereafter this false case has been lodged. In this case, FIR has been lodged after a delay of 6 days of the alleged occurrence and there is no
Patna High Court CR. MISC. No.66199 of 2023(2) dt.18-10-2023 2/2 explanation for the same. As a matter of fact, there is long standing enmity between the parties. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Add. Sessions Judge cum Spll court POCSO or concern court Bhojpur at Ara in connection with Koilwar Gidha P.S. case No. 205 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
