JUSTICE SANJAY PRIYA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kanti P.S. Case No. 366 of 2014 instituted for the offence under Sections 304B and 498A/34 of the Indian Penal Code.

Petitioner is said to be the husband of the deceased. There is specific allegation against the petitioner of committing physical and mental torture with the sister of the informant for demand of dowry and ultimately petitioner along with other accused persons killed her by strangulation.

Case diary has been received.

Learned A.P.P. has submitted that in the post mortem report doctor has found the cause of death due to asphyxia on

Patna High Court Cr.Misc. No.19827 of 2017 (3) dt.19-05-2017 2/2 account of strangulation. The witnesses have also taken the name of the petitioner in the case diary.

Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial. Petitioner is given liberty to renew his prayer for bail after nine months in the court below if no substantive progress is made in the trial. The court below will give reason if the trial is not concluded within the aforesaid period.
