Lastly, the bail application of petitioner was rejected vide order dated 11.11.2020. Trial court report reveals that out of 11 chargesheeted witnesses only 7 witnesses have been examined till date on behalf of prosecution. Similarly situated co-accused Sanjay Sah has been granted bail by this Court vide order dated 07.07.2017 passed in Cr. Misc. No. 29721 of 2017. Petitioner is in custody since 06.09.2016 having clean antecedent.

Considering the period of custody and the fact that similarly situated co-accused has been granted bail by this Court, the petitioner above-named, is directed to be enlarged on

Patna High Court CR. MISC. No.2076 of 2022(3) dt.09-03-2022 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned IIIrd Additional Sessions Judge, Gaya in connection with Barachatti P.S. Case No. 347 of 2016.
