The petitioner seeks bail in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, on 11.03.2021 at about 10.30 hrs., on the order of this petitioner, co-accused Sajid and Akbar wrapped Gamchha on the neck of informant and tried to kill him and thereafter, all of them, assaulted him by lathi, danda and iron rod, due to which, he received several injuries and when other persons came to save informant, the accused persons abused and assaulted them.

It is submitted on behalf of petitioner that as per F.I.R. itself, petitioner is alleged to be order-giver and there is general and omnibus allegation against him. The doctor found the injuries to be simple in nature caused by hard & blunt object. Petitioner is in custody since 06.11.2021.

Patna High Court CR. MISC. No.103 of 2022(2) dt.10-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Jhanjharpur, District - Madhubani / concerned court in connection with Phulparas P.S. Case No. 137 of 2021.
