2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bhagwanpur P.S. Case no. 156 of 2024 instituted for the offence under Sections 323, 341, 307, 504, 506/34 of the Indian Penal Code.

3. As per allegation in the FIR, that on the alleged date and time of occurrence, an altercation took place regarding social feast/catering, which was going on in front of the house of Chaukidar Ram Prasad Das. In the meanwhile, Subodh Das, Raja Das and the petitioner started abusing the informant Nagendra Das. Accused Subodh Das with intention to kill the informant, hit on his head with iron rod as a result of

Patna High Court CR. MISC. No. 70036 of 2024(3) dt.18-01-2025 2/3 which he fell down and with bleeding head injury. Thereafter, accused Raja Das and the petitioner started to assault him due to which he became unconscious.

4. Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence. Both parties are agnate and there is case and counter case between them. Specific allegation of inflicting iron rod blow is against Subodh Das and not against this petitioner. A statement has been made in para-3 of this petition that petitioner has got no criminal antecedent.

5. Learned APP appearing for the state has vehemently opposed the prayer of bail and submitted that on the alleged date and time of occurrence, the informant was assaulted by the present petitioner due to which he sustained severe head injury and he became unconscious. There is also allegation of repeated blow against him. Injury report of injured mentioned in para 30 and 31 of the case diary in which doctor opined that the nature of injury is grievous caused by hard and blunt object.

6. Having heard the learned counsel for the parties and considering the nature of the injury, this court is not inclined to enlarge the petitioner on bail and, as such, his
