The petitioner seeks bail in connection with Suppl. Pasraha P.S. Case No. 131 of 2018, registered for the offence under Section 302/34 of the Indian Penal Code. As per FIR, 7-8 unknown persons committed murder of husband of the informant by strangulation. It is submitted on behalf of the petitioner that petitioner is not named in the FIR and during course of investigation, his name has come in the re-statement of the informant wherein she claims to be eye witness to the alleged occurrence but no reason has been assigned on behalf of the prosecution why the petitioner is not named in FIR when she claims to be eye witnesses to the alleged occurrence. Patna High Court CR. MISC. No.674 of 2022(2) dt.21-03-2022 2/2 accused has been granted bail by a coordinate Bench of this Court vide order dated 21.08.2019 passed in Cr. Misc No. 39559 of 2019. It is further submitted that the petitioner is in custody since 27.07.2021.
Learned APP for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in connection with Suppl.
