JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 385, 387 and 506 of the I.P.C Allegedly, on mobile no. 9955679039 ransom of Rs. 10,00,000/- was demanded from the informant through mobile no. 8581935667 describing the caller as Parshuram Sena and further caused threats to kill the informant and his family members in case of failure. During investigation the name of the petitioner transpired on the basis of the call detail report and further the petitioner confessed his guilt.

Submission is of false implication and that the petitioner has been implicated due to the village dirty politics, the

Patna High Court Cr.Misc. No.50338 of 2015 (3) dt.18-02-2016 2/2 petitioner never demanded any ransom from the informant, no amount was paid by way of ransom and the petitioner is suffering in custody since 12.07.2015.

The learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances as stated above, considering detention of the petitioner, now he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Sheohar in Tariyani P.S. Case No. 83 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
