The petitioner prays for bail in Buniyadganj P.S. Case No. 28 of 2016, which was initially registered under Section 302, 394/34 of the Indian Penal Code, but later was found to be a case under Section 396, 412 of the Indian Penal Code. The cash van carrying cash was intercepted and looted by the unknown accuseds persons in which one person from the prosecution side also received injury which proved fatal. It is stated that there is no direct evidence/material incriminating the petitioner in the case diary. Merely on suspicion, the petitioner is lodged in custody since 04.04.2016. Learned APP, on the other hand, referring to the order of

Patna High Court Cr.Misc. No.48714 of 2016 (2) dt.02-12-2016 the learned Sessions Judge submits that at least three accused(s) persons on being apprehended disclosed the complicity of the petitioner in the alleged crime. From all those three accused(s) persons, recovery of the cash or gun etc. were effected. It further appears that the petitioner is an accused of a case registered in 2015 under Section 394 of the Indian Penal Code. Looking to the seriousness of the matter and other incriminating materials reflected from the impugned order, this Court is not inclined to direct him to be released on bail. The prayer is rejected.
