The petitioner seeks bail in a case registered for the offence under Section 392 of the Indian Penal Code. Petitioner is not named in the F.I.R. Name of the petitioner has surfaced during course of investigation in the confessional statement of co-accused Firoz Ansari. No incriminating article has been recovered from the possession of the petitioner and till date, he has not been put on T.I.Parade. It is further submitted that though, in the F.I.R., it is alleged that two Apache motorcycles have been used in the crime, but in the seizure list, Splendor Pro motorcycle of the petitioner has been shown to be seized from the premises of the petitioner and as such, it cannot be said that said Splendor Pro motorcycle of the petitioner has been used in the alleged crime. Petitioner claims clean antecedent and he is in custody since 27.09.2021.

Patna High Court CR. MISC. No.685 of 2022(3) dt.25-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 233 of 2021.
