After some argument learned counsel for the petitioner seeks permission to withdraw this writ petition with a liberty to avail opportunity as provided under the agreement to get it redressed through arbitration clause under Arbitration and Conciliation Act, 1996. If petitioner files such application before the Hindustan Petroleum Corporation Limited, Kolkata, in such circumstances the Hindustan Petroleum Corporation Limited

Patna High Court CWJC No.18184 of 2015 (3) dt.20-02-2017 will be obliged to give proper reply under the Act and appoint independent arbitrator in terms of amended provision as inserted under Section 12(5) of Arbitration Act, 2015.

With the aforesaid liberty this writ petition is dismissed as withdrawn.
