This application, for grant of anticipatory bail, arises out of Bihta Police Station Case No. 686 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. The allegation against the petitioners is that the petitioners, along with other co-accused persons, assaulted the brother of the informant by means of iron-rod, lathi, danda, resulting in his death.
Learned Counsel for the petitioners submits that none has seen the occurrence and as per the First Information Report, the informant came to know about the occurrence when he
Patna High Court CR. MISC. No.61579 of 2019(2) dt.16-10-2019 2/2 visited the house of the petitioners and did not find any inmates of the house there. He further submits that the petitioners are women and their involvement in the offence is not very specific. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the offence has been committed by all the accused persons, as would be evident from the First Information Report itself and the petitioners are named in the First Information Report, I am not inclined to grant the petitioners privilege of anticipatory bail. This application is, accordingly, dismissed.
