1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with D.R.I. Case no. 3 of 2021 (N.D.P.S. Case no. 15 of 2021) registered under sections 20, 25 and 29 of the N.D.P.S. Act.

3. As per the prosecution case, eighty packets containing a total of 1076.77 kgs. of ganga was recovered from the truck being driven by this petitioner. The substance recovered was valued at Rs. 1,58,72,550/-.

4. It has been submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was merely a driver engaged to reach the vehicle in

Patna High Court CR. MISC. No.65813 of 2023(3) dt.13-12-2023 2/2 question along with the goods loaded which had been loaded by the owner. The petitioner did not know the contents of the goods loaded. The petitioner has no criminal antecedent and he is in custody since 18.2.2021.

5. The application for bail is opposed by learned APP for the State.

6. A report was called for from the learned trial Court. As per the report received, charge has been framed in the learned trial Court on 27.5.2022 and two out of the seven prosecution witnesses have been examined. The trial is expected to conclude in six months

7. Having heard learned counsel for the parties and taking into consideration, the allegations in the F.I.R, recovery of 1076.77 kgs. of ganga from the truck being driven by this petitioner together with the trial in the learned trial Court having proceeded, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
