JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 305 of 2018, disclosing offences under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

As per the complaint case, petitioner happens to be the husband of the complainant. There is allegation of demand of Rs.2,00,000/- and had solemnized marriage with another lady.

Submission of learned counsel for the petitioner is that there is no specific allegation against the petitioner and he has falsely been implicated in the present case. He further submits that he has not solemnized the second marriage with

Patna High Court CR. MISC. No.63534 of 2019(3) dt.03-12-2019 2/2 another lady and there was no case found under Section 494 of the Indian Penal Code. His further submission is that he is ready to keep her with dignity and care.

On the other hand learned counsel for the complainant has opposed the prayer for anticipatory bail on the ground that petitioner has solemnized marriage with another lady as such she is not ready to reside with him rather she is ready for one time settlement.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is allowed. The provisional bail granted to the petitioner vide order dated 22.10.2019 is confirmed with condition that if the opposite party no.2 is ready to reside with the petitioner, he has to keep her with full dignity and care.
