1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Gopalpur (Bangra) P.S. Case no.11 of 2020 registered under sections 302, 120B, 323, 341 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to be the assailant of the deceased.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 4.10.2021 passed in Cr. Misc. no.17025 of 2021. Inspite of the petitioner having remained in custody since 26.5.2020, the trial is still continuing and there is no chance of the same concluding in the near future.

5. Heard learned A.P.P. for the State.

6. A report was called for from the learned trial Court. As per the contents of the report, four witnesses have been examined on behalf of the prosecution while three Investigating Officers and the doctor remain to be examined.

7. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R. together with the trial having proceeded to a great extent, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
