JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 16 of 2016 for the offence punishable under sections 379 of the Indian Penal Code pending in the court of the learned Additional Chief Judicial Magistrate, Bhagalpur.

From perusal of the impugned order, it appears that while dismissing the prayer for bail of the petitioner, the court below has already directed the trial court to conclude the trial of the petitioner within four months and if the trial is not concluded within the period aforesaid, the learned trial court shall enlarge the petitioner on bail on the appropriate condition to his own

Patna High Court Cr.Misc. No.48634 of 2016 (3) dt.18-01-2017 2/2 satisfaction.

In view of the aforesaid facts, I am not inclined to grant bail to the petitioner.

However, in view of the above observation of the learned Additional Sessions Judge VI, Bhagalpur the petitioner should move the learned court below which will be considered as per the direction of the learned Additional Sessions Judge VI, Bhagalpur.

With the above observation, this application for bail is disposed of.
