ANJANA MISHRA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Saharsa P.S. Case No. 06 of 2015 registered for the offences punishable under Sections 341, 342, 323, 324, 502/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that though petitioner is not named in the FIR but on the basis of the recovery of petitioner's motorcycle at the place of occurrence, the house of the petitioner was raided and several items of jewellary belonging to his shop were seized therefrom. It is further submitted that on Hulla having been raised at the place of occurrence, the petitioner and the informant had run away from there as there had been

Considering the nature of allegations and also the fact that the petitioner who is an accused in connection with another case i.e, Saharsa Sadar P.S. Case No. 362 of 2015, has been granted bail which is a separate case registered for recovery of the alleged jewellery, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Railway, Khagaria in connection with Saharsa Rail P.S. Case No. 06 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Anjana Mishra, J) Jagdish/- U T
