JUSTICE BIRENDRA KUMAR ORAL ORDER 30-05-2017 This is a regular bail matter. On refusal of the prayer by the learned Special Judge, this appeal has been preferred under Section 14(A) of the SC/ST (Prevention of Atrocities) Act, 1989.

The appellant is one of the accused in connection with Dinara P.S. Case No. 01 of 2017 registered under Sections 363, 366(A)/34 of the Indian Penal Code as well as under Sections 3(1) (r) of the SC & ST (Prevention of Atrocities) Act. The allegation is that the appellant and others kidnapped to the minor sister of the informant. The victim girl in her statement under Section 164 Cr.P.C stated that co-accused Pintu Chaudhary and this appellant had induced her to go with them and co-accused Pintu Chaudhary had promised to give her

Patna High Court CR. APP (SJ) No.1330 of 2017 (2) dt.30-05-2017 2/2 money and to marry with her. The allegation of physical relationship is against co-accused Pintu Chaudhary. The matter relates to the love affairs.

Considering the aforesaid facts and circumstances of the case, let the appellant, above named, during the pendency of this appeal, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Rohtas at Sasaram in connection with Dinara P.S. Case No. 01 of 2017.

This appeal stands allowed accordingly.
