JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This is an application for grant of anticipatory bail in connection with Bachhwara P. S. Case No. 93 of 2019, disclosing offences under Sections 341, 323, 379, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. there is allegation against petitioners no. 1to 3 of assault to the husband of the informant by rod and Danda and against petitioners no. 4 to 6 of assault to Sogarat Rai and Sanjit Rai

Patna High Court CR. MISC. No.58153 of 2019(2) dt.16-09-2019 2/2 and there is also allegation of firing but that does not hit anybody. There is allegation of assault to the informant also. Submission of the learned counsel for the petitioners is that there is allegation attributed against these petitioners of assault to the husband of the informant and Sogarat Rai and Sanjit Rai and injuries were found to be simple in nature. There is land dispute between the parties. So far as injury of informant is concerned, which was found to be grievous in nature, but the same has not been attributed against them.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bachhwara P. S. Case No. 93 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
