The petitioner is in custody in connection with Rajoun P.S. Case No.161 of 2015 for the offence punishable under Section 394 of the Indian Penal Code.

The F.I.R. is against unknown and charges the accused of causing road robbery on the informant and during which process the motorcycle as well as the respective mobiles of the informant and his friend was taken away. The allegation against this petitioner is of recovery of one of the mobiles. Mr. Ajay Mukherjee learned counsel for the petitioner has submitted that in absence of IMEI number it would be difficult to identify the mobile and that neither the mobile or the petitioner has been put on T.I. Having heard learned counsel for the parties and considering the submissions so advanced, let the petitioner namely, Arbind Kumar Yadav be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No.161 of 2015 subject to the condition that in case the petitioner after his release is found involved in any further case of similar nature the bail bond of the petitioner would be cancelled by the Court below.
