ANJANA MISHRA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners apprehended their arrest in connection with Amdabad P.S. Case No. 94/2015 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

The petitioners are the wives of agnates of the deceased, who is said to have been attacked by the petitioners. It is submitted that there is history of litigation between the parties and on account of same, the petitioners have also been named in the F.I.R.

Learned counsel appearing on behalf of the petitioners submits that after perusal of case diary, actually the

Patna High Court Cr.Misc. No.50700 of 2015 (6) dt.29-03-2016 2/2 case has been found true under Section 304A of the Indian Penal Code and not under Section 302 of the Indian Penal Code. Considering the nature of allegation and that these petitioners do not have specific role in the offence, let the petitioners, above named in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Katihar in connection with Amdabad P.S. Case No. 94/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
