JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 459 of 2016, registered under Sections 420 and 406 of the Indian Penal Code.

The accusation is that petitioner being the staff of the Patna High Court, Patna, took cash of Rs.5,00,000/- from the informant for providing the job but neither the job provided to the informant nor the money is returned by this petitioner. Learned counsel for the petitioner and the learned counsel for the informant jointly submit that the dispute in between the petitioner and the informant has already been settled and the informant has no grievance to the petitioner. Further

Patna High Court Cr.Misc. No.20074 of 2017 (6) dt.03-08-2017 submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 459 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
