NILU AGRAWAL ORAL ORDER 10-12-2015 Heard learned counsel for the petitioners and learned Special P.P. for the State.

The petitioners apprehend their arrest in connection with Amdabad P.S.Case No. 91/2015 registered for offences punishable under Sections 341, 504, 506 of the Indian Penal Code and 3 (i) (x) SC/ST Act.

The prosecution case as per F.I.R. is that on the alleged date of occurrence at 6.00 P.M., while the informant was going to purchase Prasad for Shiv Charcha both the petitioners stopped her and started abusing her by caste name and asked her as to why she has lodged case against the petitioner Girdhari and further threatened to shoot her. Both the petitioners were armed with sharp cutting weapons. The informant frightened, escaped from there and came to her house. On hearing her hulla, villagers

Patna High Court Cr.Misc. No.51350 of 2015 (2) dt.10-12-2015 2/2 assembled there but being terrified with the petitioners, they did not dare to speak anything against them.

It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and have been falsely implicated in the aforesaid case.

It has further been submitted that no offence under Section 3(i) (x) of the S.C./S.T. Act is made out and the allegations made against the petitioners are not specific. Furthermore, the matter has been compromised between the parties as is evident from Annexure-2 of this petition. Be that as it may, let the above named petitioners in the event of their arrest or surrender before the Court below within a period of six weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of Shri B.K. Chaudhary, learned Judicial Magistrate, 1st class, Katihar in connection with Amdabad P.S.Case No. 91/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P. C.
