JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-06-2017 Heard leaned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Pakridayal P.S. Case No. 114 of 2016 for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 47, 51,52, 53 and 54 of Bihar Excise Amendment Act, 2016.
The petitioner has stated in paragraph No.3 that he is merely a Chowkidar in M/s Rudra Enterprises Pvt. Ltd. The alleged liquor was seized on 18.08.2016 and the said liquor is said to be belongs to one Balmiki Singh. The partner of M/s Rudra Enterprises Pvt. Ltd., namely, Akhilesh Kumar Singh @ Akhilesh Singh, where the petitioner is only a Chowkidar, was granted Anticipatory Bail by this Hon'ble Court vide order dated
Patna High Court Cr.Misc. No.20105 of 2017 (2) dt.01-06-2017 2/2 23.12.2016 in Criminal Miscellaneous No.54774 of 2016. In view of the fact that the partner of M/s Rudra Enterprises Pvt. Ltd was granted Anticipatory Bail, there is no reason to deny the anticipatory bail to this petitioner, who is only Chowkidar in the said company. Let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the receipt or production of the order, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran or his successor Court in connection with Pakridayal P.S. Case No. 114 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
