The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

As per allegation in the FIR, deceased has no male issue and with a view to grab her property, petitioner in connivance with his other family members had administered poison to the deceased and tried to cremate the dead body in absence of her sole daughter.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. In fact, during investigation, this fact has come that deceased herself

Petitioner and villagers tried to save her life by bringing her to a specialist doctor. No poison like substance has been detected in the FSL report. Petitioner has no criminal antecedent and he is languishing in judicial custody since 26.06.2022. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Manjhaul in connection with Khodawandpur P.S. Case No. 186 of 2022.
