2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 190, 303(2), 126(2), 115(2), 118(1), 117(2), 109, 352, 351(2) of the Bhartiya Nyaya Sanhita.
3. As per the prosecution case, on 21.4.2025 at about 8.30 AM, due to previous land dispute, all the FIR named accused persons, including these petitioners, variously armed, surrounded son of informant and started abusing him and on protest, on the order of the petitioner no.1 (Devki Rai), coaccused Bhogendra Kumar inflicted knife on the head of son of informant and thereafter, other co-accused persons started assaulting his son by means of bricks causing fracture injury in his chest. It is further alleged that when informant went to save
Patna High Court CR. MISC. No.63501 of 2025(2) dt.15-09-2025 2/2 her son, she was also assaulted by the accused persons and coaccused Parshuram Rai tore her clothes, whereas co-accused Bhogendra Kumar snatched her gold Mangal-Sutra.
4. Learned counsel for the petitioners submits that specific accusation of assault with knife is against co-accused Bhogendra Kumar. So far as these two petitioners are concerned, there is general & omnibus allegation. Case and counter case. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Pupari, Sitamarhi in connection with Bajpatti P.S. Case No. 87 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
