JUSTICE SANJAY PRIYA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kalyanpur P.S. Case No. 104 of 2016 instituted for the offence under Sections 302/201 of the Indian Penal Code.

As per written report son of the informant (since deceased) along with one Ram Daresh Rai @ Chhotu had gone towards Ram Bhadrapur Station for walking but he did not return. It has further been alleged that Ramesh Rai (petitioner) threatened her about one month ago that he would kill her son Brajesh Kumar @ Vijay (since deceased) as he used to play whistle on seeing his daughter in order to insult her. In this manner in the written report mere suspicion has been raised against the petitioner. There is no allegation of any specific overt

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case No. 104 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
