JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-05-2017 The petitioner is apprehending his arrest in connection with Madhepura P.S. Case No. 351 of 2014, registered for offences punishable under Sections 399, 402, 414 Indian Penal Code and Section 25(1-b)1/26/35 Arms Act.

It has been submitted on behalf of the petitioner that petitioner's name transpired in this case only on the basis of confessional statement of co-accused and save and except the said confessional statement, there is nothing against the petitioner so as to connect him with the present case. Petitioner has no criminal antecedent.

Learned counsel for the State opposed the prayer for bail and submitted that there is complicity of the petitioner in this case.

No.53400 of 2016 (6) dt.04-05-2017 2/2 Having heard both sides, in view the facts and circumstances of the case, nature of allegation and also that the case is of the year 2014 and the petitioner has now come for grant of anticipatory bail, considering all these facts, I am not inclined to grant the petitioner the privilege of bail, his application for anticipatory bail is accordingly rejected.

Let petitioner surrender before the court below and make prayer for regular bail, which will be considered by the court below on the merit of the case without being prejudiced by the order of this Court.
