Petitioner seeks bail in a case registered for the offence punishable under Section 370 of the Indian Penal Code and Section 16 of the Bounded Labour System Abolition Act, 1976. Petitioner is in custody since more than six months for allegation that he was carrying the children for labour purpose.
The petitioner has stated on oath that he has got no criminal antecedent and the children were going to meet their relations working with the petitioner with the consent of their family members.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.20287 of 2017 (2) dt.01-05-2017 2/2 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate (Rail) Samastipur/successor Court in connection with Darbhanga (Sitamarhi) Rail Police Station Case No. 85 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
