JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Saharsa P.S. Case No. 517 of 2015 registered under Sections 457, 380 and 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that one mobile set was found in the house of the informant, which is said to be left by the thieves but the petitioner has falsely been implicated in this case mere on suspicion as it was detected that the alleged mobile set was also used to talked to the mobile of this petitioner, except that there is nothing against the petitioner and also the alleged recover mobile set is not belonging to the petitioner. It is further submitted that

Patna High Court Cr.Misc. No.51455 of 2015 (2) dt.21-12-2015 petitioner is accused in two other cases, but in both cases, he is on bail and is in custody since 29.07.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa P.S. Case No. 517 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
