JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A, 376, 504/34 of the Indian Penal Code.
The accusation is kidnapping the daughter of the informant and ravishing her. The victim in her 164 Cr.P.C statement got her age recorded as 14 years whereas learned Court below assessed as 16 years, where she stated that petitioner being mother of co-accused Rajan took her to her house and thereafter she went in the company of co-accused Rajan and Chhatu Sah through an auto rickshaw when coaccused Chhatu Sah administered some intoxicant to the daughter of the informant. Co-accused Rajan took her to Gorakhpur and kept her for a month. She also stated that Rajan established physical relationship.
It is submitted by learned counsel for the petitioner that petitioner happens to be mother of co-accused
Patna High Court Cr.Misc. No.51437 of 2015 (2) dt.10-11-2015 2/2 Rajan and she has been roped in the present case. The victim went traceless on 12.04.2015 and she was recovered on 12.05.2015 for which a complaint was filed on 25.05.2015 which came to be registered as police case on 05.07.2015. Considering the delayed lodging of the F.I.R and the thrust of accusation against co-accused Rajan, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan in connection with Mahila P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
