The petitioner seeks bail in a case instituted under Sections 396, 412 of the Indian Penal Code and Sections 25 (1-B) A, 26, 27 and 35 of the Arms Act.
The prosecution story, in brief, is that on 06.05.2016/07.05.2016 in the night, a dacoity was committed in the house of the deceased and in course of committing the said crime, the deceased was killed.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.05.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. His
Patna High Court Cr.Misc. No.50318 of 2016 (2) dt.21-11-2016 2/2 name has come in the F.I.R. on the disclosure made by other coaccused. No arm is said to have been recovered from his conscious possession.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rdAdditional Sessions Judge, Bhagalpur in connection with S.T. No. 609 of 2016, arising out of Sultanganj P.S. Case No. 74 of 2016. (Sudhir Singh, J.) Amit/- U T
