The petitioner is apprehending his arrest in a complaint case wherein cognizance has been taken for the offences punishable under Sections 341, 323, 498(A) of the Indian Penal Code.
It is a case of cruelty due to none-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in
Patna High Court CR. MISC. No.1496 of 2022(4) dt.30-08-2022 2/2 this case. In fact, the complainant is a quarrelsome lady and she has made false allegation against the petitioner. The petitioner, in the changed circumstance, is not ready to keep the complainant as wife with full dignity and honour. The petitioner also denies to make any maintenance to the complainant.
In contra, learned counsel appearing on behalf of the complainant has submitted that complainant is ready to live with the petitioner but it is the petitioner who is not willing to keep the complainant as wife with full dignity and honour.
In the facts and circumstance of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
The prayer for grant of anticipatory bail to the petitioner stands rejected.
