The petitioners have preferred this application for grant of regular bail in a case registered under sections 30(a) and 37(2) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 516.06 litres of liquor was recovered from the house of Mahavir Choudhary. While Mahavir Chaudhary was taken into custody the other accused persons managed to flee away. The petitioners were named as the accused who had managed to flee away.

It is submitted by learned counsel for the petitioners that neither the petitioners were arrested at the spot nor any incriminating article has been recovered from their

Patna High Court CR. MISC. No.1745 of 2022(2) dt.09-06-2022 2/2 possession. They have no concern nor any connection with the coaccused Mahavir Choudhary. They have no criminal antecedent and are in custody since 7.11.2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioners not having been arrested at the spot, their having no any criminal antecedent and having remained in custody for 7 months, the Court directs both the petitioners to be enlarged on bail in connection with Dhansoi P.S. Case no. 210 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Buxar.
