Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 147, 149, 341, 323, 325, 307 and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is a case and counter case between the parties and in the alleged occurrence, both sides have sustained injuries. The only allegation against the petitioner is that he tried to strangulate the informant's son but the injury report does not support the said version of the informant.

Heard learned A.P.P. also.

Considering the submission, as above, this application is

Patna High Court Cr.Misc. No.48668 of 2016 (2) dt.16-12-2016 2/2 allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar learned Judicial Magistrate, Supaul, in connection with Bhimpur P.S. Case No. 53 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
