The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 325, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that for the past one month the thieves have created nuisance in the village. Sometimes they used to take away goats and kill them and in the night they used to cut electric wire from transformer. It is alleged that on 08.07.2018, the villagers chased them and caught hold co-accused

Patna High Court CR. MISC. No.1424 of 2022(2) dt.26-07-2022 2/3 Deepak Pandey, Raja, Prince and 3-4 unknown who were damaging the transformer and trying to steal the copper wire. One Madan Singh was also assisting them. The villagers thereafter inform to the police but before the police could came, the other accused persons attacked on the villagers and got the accused persons released from the clutches of the villagers. They also fired in the air and escaped from the scene.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on

No.1424 of 2022(2) dt.26-07-2022 3/3 furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 728 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
