The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 364, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the six named accused persons including the petitioner herein took away the informant's son and, thereafter, her son did not return. Soon, thereafter, the dead body of her son was recovered. It is submitted by learned counsel for the petitioner the petitioner has been falsely implicated in the case for oblique reason. Admittedly, the informant is not an eye witness to the occurrence and at best the case against the petitioner is one of last seen. The petitioner is in custody since 24.6.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the material that has transpired in course of investigation, the petitioner having remained in custody for more than 1 year 6 months since 24.6.2021 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Hathauri P.S. Case no. 140 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur East, District Muzaffarpur.
