The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 188, 341, 323, 353, 504 of the Indian Penal Code.
The prosecution case as per F.I.R is that when the informant along with other police personnel came to pacify the matter after getting information that groups of two people are fighting with each other, they were misbehaved and abused and obstruction was made in discharge of official duties of the police personnel.
Patna High Court CR. MISC. No.1405 of 2022(2) dt.29-06-2022 2/2 It is submitted by learned counsel for the petitioners that there is general and omnibus allegation against the petitioners. Moreover, no one sustained any injury in the occurrence. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut (Chero) P.S. Case No. 462 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
