JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Nokha P.S. Case No. 01 of 2016 registered under Sections 147, 148, 341, 323, 324, 307 of the I.P.C. and 27 of the Arms Act pending in the Court of A.C.J.M.-5th, Sasaram, Rohtas. The accusation is of taking attempt to kill the granddaughter of the informant by means of rifle. Submission is that petitioner, being an Army Man, has falsely been implicated in this case due to land dispute in between the parties.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is also accused in Nokha P.S. Case No. 93 of 2015 for

Patna High Court Cr.Misc. No.48899 of 2016 (4) dt.08-02-2017 2/2 the offence under sections 307, 341 and 323 of the I.P.C. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
