2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 and 395 of the Indian Penal Code.
3. As per allegation in the FIR, at night on 23.12.2021 while the informant and his family members are sleeping in his house, three miscreants barged into the house and took away Rs. Two lacs and ornaments and fled away.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR not put on TIP. Nothing has been recovered from the house of the petitioner or from his
Patna High Court CR. MISC. No.65904 of 2023(3) dt.08-01-2024 2/2 conscious possession. During investigation, no consistent evidence has come against the petitioner to show his involvement in the present case. Petitioner is languishing in judicial custody since 25.3.2022.
5. The application for bail is opposed by learned APP for the State and submitted that petitioner is a habitual offender and nine criminal cases of like nature are pending against him.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Saran at Chapra in connection with Marhowrah P.S. Case No. 738 of 2021.
