JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 47 of the Bihar Excise Amendment Act. Allegation against petitioner is that from his possession 48.6 litres of country made liquor was recovered. It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. He is in custody since 2.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 48.6 litres of country made wine was recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.50509 of 2016 (2) dt.24-11-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Muffasil P.S. Case no. 311 of 2016.
