2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 91(2), 191(3), 190, 126 (2), 115 (2), 117 (2), 109, 308 (2), 303 (2), 352 and 351 (2) and of Bhartiya Nyaya Sanhita, 2023 .
3 . The prosecution case in brief, is that informant namely , Ranjan Kumar alleged that on 11.10.2024 , when he was returning home , this petitioner along with other coaccused persons surrounded him and assaulted him and also looted cash of Rs. 5,000/- from the pocket of informant.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.62989 of 2025(2) dt.10-09-2025 2/3 specific accusation is against other co-accused person . Allegation is general and omnibus against this petitioner. No specific allegation of any overt act is alleged against him. The present case has already been compromised between the parties for which a joint compromise petition dated 22.10.2024 was filed in the Court below i. e ,. Annexure - P / 2 to the bail petition . Similarly situated co-accused persons have already granted bail by this Court vide order dated 05.02.2025 in Cr. Misc. No. 1409 of 2025 and order dated 08.08.2025 in Cr. Misc. No. 54561 of 2025 .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that the matter has already been compromised between the parties, similarly situated coaccused persons with similar allegations have already been granted bail by Co-ordinate bench of this Hon'ble Court and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Sikarhana at Dhaka , East Champaran , Motihari in connection with
Patna High Court CR. MISC. No.62989 of 2025(2) dt.10-09-2025 3/3 Ghorasahan P.S. Case No. 396 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
