The petitioner has filed the instant application for grant of regular bail in connection with Bathnaha P.S. Case No. 124 of 2022 registered under section 414 of the Indian Penal Code.

Prosecution case in short is that on suspicion, the police apprehended the petitioner and one another co-accused with a motorcycle and on interrogation, they said that the alleged motorcycle is of stolen one.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to ulterior motive. It is

No.62712 of 2022(2) dt.24-02-2023 2/2 submitted that from perusal of seizure list, it appears that nothing has been recovered from the possession of the petitioner rather the alleged recovery has been made at Haidara Mill NH77. He has no concern with the alleged recovery of motorcycle and he has not put his signature on the seizure list. He is languishing in judicial custody since 05.05.2022. The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bathnaha P.S. Case No. 124 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi.
