2. The petitioner seeks bail in connection with S.Tr. No. 423 of 2018 arising out of Balrampur P.S. Case No. 89 of 2018 registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to be involved in the killing of the deceased.

4. The petitioner is a lady and she is in jail since 3.8.2018 i.e. more than six years.

5. Learned counsel for the petitioner submits that the trial is being delayed because one co-accused, who is not related to the petitioner, has absconded.

6. Considering the period of custody and the delay in trial, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, III, Katihar in connection with S.Tr. No. 423 of 2018 arising out of Balrampur P.S. Case No. 89 of 2018, subject to the condition that the bailors should be close blood relative of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
