The petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 54 of 2019, registered under Sections 414/34 of the Indian Penal Code, Section 30(a)(d) of the Bihar Excise Act and Sections 18, 19, 20 and 21 of the N.D.P.S. Act, pending in the court of S.D.J.M., Sherghati, Gaya. The accusation is of recovery of 40 litres country made liquor and three empty cartridges from the house of the petitioner.

Learned counsel for the petitioner submits that, in fact, search was made in absence of the petitioner. Having considered the facts and circumstances of

Patna High Court CR. MISC. No.62342 of 2019(2) dt.15-10-2019 2/2 the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
