2. The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 80, 238, 3(5) of the B.N.S.
3. The allegation in the first information report is that the daughter of the informant was done to death by the accused persons including the present petitioner on account of nonfulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that it would be apparent from the reading of the first information report itself that the informant was duly informed about the fact that his daughter had suffered an electric current and she was also being taken for treatment, however, she died. It is further submitted that the petitioner is a unmarried sister-in-law (Nanad) and is also a student who is preparing for competitive
Patna High Court CR. MISC. No.62607 of 2025(2) dt.15-09-2025 2/2 examination while the husband, who is primarily responsible for the welfare of his wife, is in judicial custody as stated in para-5 of the petition.
5. Learned APP for the State has opposed the application for anticipatory bail.
6. Taking into consideration the facts and circumstances and also considering the general and omnibus allegations and the further fact of information about the death of the deceased caused due to suffering electric current and further considering the fact that the husband is already in custody, let the above named petitioner, who is a young girl having no criminal antecedent, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahkar P.S. Case No. 188 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S. (Soni Shrivastava, J) devendra/- U T
