03-12-2015 Heard Sri Raju Kumar, learned counsel for the petitioner and Sri Ram Bachan Singh, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 26-08-2015 in Pear P.S. Case No. 35 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and subsequently section 302 of the I.P.C. was added, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that in the F.I.R., the informant had specifically asserted regarding involvement of two accused persons, however; subsequently, on protest petition, petitioner's name has come. In view of the facts and circumstances, particularly

No.52129 of 2015 (2) dt.03-12-2015 2/2 the fact that in the F.I.R. the informant had specifically asserted regarding giving knife blow to the father and mother of the informant and there was no assertion regarding presence of the petitioner, the petitioner deserves to be enlarged on bail. Let the petitioner namely Samina Khatoon @ Kajal Khatoon @ Sakina Khatoon @ Kajal be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Roy, learned Judicial Magistrate 1st Class, Muzaffarpur/concerned court in connection with Pear P.S. Case No. 35 of 2015. (Rakesh Kumar, J.) Anay U T
