An unsuccessful attempt is said to have been made at the end of petitioner to rape informant, Rinku Devi in the night of 04.05.2016 and during course thereof, assault was made and for that, written report was filed on 11.05.2016. There happens to be specific disclosure that during intermediary period, she was going under treatment at Purnea. However, from Para-7 of the order, which is based upon materials having been collected by the I.O. during course of investigation (case diary), same is not at all substantiated. Petitioner is under custody since 12.09.2016, having no criminal antecedent as is evident from Para-3 of the petition. Accordingly, petitioner, Bimal Yadav is directed to
